Verdict finding UTEX Breached its contract with GD Energy, no infringement by GD Energy, and that UTEX’s patent is invalid

AUSTIN – August 7, 2026 – GD Energy Products, LLC (“GD Energy”) today announced that a jury in the U.S. District Court for the Western District of Texas has decided in favor of GD Energy in a breach of contract and patent infringement case against UTEX Industries, Inc. (“UTEX”). In connection with this verdict, the jury found that UTEX breached a covenant not to sue GD Energy, that GD Energy does not infringe UTEX’s patent, and that UTEX’s patent is invalid.

UTEX’s lawsuit against GD Energy was filed on July 22, 2024, alleging that GD Energy infringed U.S. Patent No. 10,428,949 (the “’949 Patent”). GD Energy counterclaimed for UTEX’s breach of its contract with GD Energy. The evidence presented at trial demonstrated that UTEX had breached its covenant not to sue GD Energy by bringing the lawsuit accusing GD Energy’s Redline+ header ring of infringement, that GD Energy’s Redline+ header ring does not infringe UTEX’s ’949 patent, and that the ’949 patent is invalid.
